IN THE MATTER of an Inquiry into the conduct of

GARTH WALLBRIDGE

arising from and in relation to Discipline File No. 1901--0429

NOTICE OF HEARING

TAKE NOTICE THAT pursuant to the provisions of Section 24.5 (5) of the Legal Profession Act, an inquiry will take place by Alex Godfrey, Sole Inquirer into the following matters relating to the conduct of Garth Wallbridge.

It is alleged that the conduct of in the matter of this complaint constitutes conduct deserving of discipline in that:

  1. Between July 13 and November 28, 2018 you acted in a conflict of interest by:

                  -continuing to take instructions from your corporate client, AGL Flooring Ltd., after a dispute arose between its two directors, Dustin Lebrun and Teresa Lebrun; and their instructions to you differed;

                  -giving legal advice to, taking instructions from and/or implementing instructions from one director, Teresa Lebrun, contrary to the instructions of the other director, Dustin Lebrun;

being contrary to section 6 of the Code of Conduct and that such conduct is deserving of discipline.

  1. On or about November 2, 2018 you acted in a conflict of interest between you/your firm and the corporate client, AGL Flooring Ltd. by:

                   -acting in your own self-interest in preparing and filing the discontinuance of action on the instructions of one of the directors which was commenced against you by the other director on behalf of the corporation to recover payment for the services and materials it  rendered to you personally;

being contrary to section 6 of the Code of Conduct and that such conduct is deserving of discipline.

  1. Between July 13 and November 28, 2018 you failed to serve your client, AGL Flooring Ltd. by failing to inform the Board of Directors of the company that you could only act with clear instructions from the Board of Directors given the conflicting directions being received from the individual directors;

being contrary to section 4 of the Code of Conduct and that such conduct is deserving of discipline

The inquiry will be conducted virtually.  It shall commence on Tuesday, September 1, 2020, commencing at 9:30 a.m.
