Notice of Decisions

In the Matter of the inquiry into the conduct of Douglas McNiven, a member of the Law Society of the Northwest Territories;

Discipline File No. 2015-0396, heard at Yellowknife, NT on February 4, 2016, the decision is as follows:

The Member is reprimanded for the conduct as set out in Citations 1, 2, 3, 4, 5, 6, 7, 8 and 10. The Member is ordered to pay fines totaling $2,000, and costs of the hearing in the amount of $5,500, for a total of $7,500.

-Citation 1- He did not adequately disclose his professional relationship with RF and RGML to TS and that such conduct is conduct deserving of discipline;

-Citation 2- He did not have TS' informed consent to act jointly for him and for RF and RGML and that such conduct is conduct deserving of discipline;

-Citation 3- He acted for one joint client or clients against the interests of another joint client and that such conduct is conduct deserving of discipline;

-Citation 4- He did not competently perform the legal services he undertook and completed for his joint clients and that such conduct is conduct deserving of discipline;

-Citation 5- He failed to promptly report to one joint client after completing legal work and that such conduct is conduct deserving of discipline;

-Citation 6- He failed to withdraw as counsel for his joint clients when a dispute arose between them and that such conduct is conduct deserving of discipline;

-Citation 7- He failed to disclose to his joint clients information given him by one of them and that such conduct is conduct deserving of discipline;

-Citation 8- He advised one joint client in a dispute between the joint clients and that such conduct is conduct deserving of discipline;

-Citation 10- He failed to answer his client's reasonable requests for information and that such conduct is conduct deserving of discipline.
