Renewals Members are reminded that annual membership renewal documents and
fees are due on March 31, 2010. You will find all necessary forms and information on the Law Society
website: http://www.lawsociety.nt.ca/membership/renewals.html Thursday, February 11, 2010 - 12:00pm The CBA-NT Family Law Section will be meeting this Thursday,
February 11, at the Law Society Boardroom. Those interested in attending must register with the Law Society office no later than
Wednesday, February 10.
Tuesday, February 16, 2010 - 12:00pm The Recruitment & Retention Committee will be meeting next Tuesday,
February 16, at the Law Society Boardroom. Those interested in attending should register with the Law Society office no later than Monday,
February 15.
Thursday, February 18, 2010 - 12:00pm The Legal Ethics & Practice Committee will be meeting next
Thursday, February 18, at the Law Society Boardroom. Those interested in attending should register with the Law Society office (by reply) no
later than Tuesday, February 17.
Friday, February 19, 2010 - 12:00pm Section 24(2) of the Canadian Charter of Rights reads: "Where, in
proceedings under subsection (1), a court concludes that evidence was
obtained in a manner that infringed or denied any rights or freedoms
guaranteed by this Charter, the evidence shall be excluded if it is
established that, having regard to all the circumstances, the admission of
it in the proceedings would bring the administration of justice into
disrepute." On February 19, 2010, the Hon. Judge Schmaltz will unravel the "new"
section 24(2) test introduced by the Supreme Court of Canada last summer
complete with tips and thoughts on how to present a winning
Charter-based argument, whether as the prosecution or defense. Register for this Lunch &

Tuesday, February 23, 2010 - 12:00 pm The Law Society appreciates the efforts of its Committee members and
other volunteers throughout the 2009/2010 Year. As a way of
expressing this, all volunteers are invited to the annual Volunteer
Appreciation Luncheon. Invitations have
been emailed to all Law Society volunteers. Any member who has
experienced difficulties opening their invitation or who believes they did
not receive an email invitation are encouraged to contact the Law Society
office.
Friday, February 26, 2010 - 5:00 pm The CBA-NT invites all women lawyers in the Northwest
Territories to a wine & cheese reception to introduce the CBA-NT's new
Women Lawyers Forum. Join special guest speaker Judith L. Huddart (Dranoff & Huddart,
Toronto), current Secretary/Treasurer of the CBA National Womens Lawyer
Forum, as she helps welcome this new section of the CBA-NT. Download the poster: Monday, March 1, 2010 - 12:15 pm The CBA-NT will be holding its annual Mid-Winter meeting on Monday,
March 1st, 2010. All CBA members are encouraged to attend. For more information, visit the CBA-NT website: Minister of Justice and Attorney General Jackson Lafferty has announced
the appointment of Mr. Garth Malakoe as a Judge of the
Territorial Court. Mr. Malakoe has been a resident of the Northwest Territories since
1980, and graduated from the University of Toronto's law school in
1987. Since then, he has worked for the Yellowknife-based firm
Peterson, Stang and Malakoe, becoming a partner in 1993. His diverse
experience in the practice of law has recently focused on corporate
commercial advice for clients throughout the North and on litigation in
courts and before administrative boards. Mr. Malakoe has also been active in community associations such as the
Yellowknife Association of Concerned Citizens for Seniors, the Yellowknife
Chamber of Commerce and the Northwest Territories Mental Health
Association. Mr. Malakoe will be sworn in at the Yellowknife Courthouse. The date of
the swearing-in has not been
set. Two lists have been released that detail authorities which
the Territorial Court does not require parties to reproduce in their book
of authorities. This applies to motions, trials and summary
conviction appeals. If a party intends to rely on any of these cases, the Court requires
that the party make reference to the specific paragraphs of the judgment
to be relied on (by paragraph number) in their written argument. Those
references must be to the version of the judgment as reported in the
citation reference noted in the attached Appendices. The Appendices may be up-dated from time to time so the most recent
version of the Practice Direction must be consulted. Practice Directions from the Courts of the NWT may be found at
